Proposals to give the main Irish consumer watchdog greater powers will pave the way for greater protection for consumers and promote fair competition, a Fine Gael TD has said.
The Department of Enterprise, Tourism and Employment is currently developing a Miscellaneous Consumer Protection, Competition and Enforcement Bill. The proposed legislation aims to improve consumer rights, tackle unfair business practices and give the Consumer and Competition Protection Commission (CCPC) more effective tools to act quickly when problems arise.
Deputy John Clendennen said the proposals are about making the system work better for ordinary consumers.
“Consumers deserve clear rules, fair prices and strong protection when things go wrong. These proposals will give the CCPC more practical powers to deal with serious breaches of consumer law without long and costly court processes,” he said.
One of the key measures under consideration would allow the CCPC to impose administrative financial sanctions for serious breaches of consumer law. This means the regulator could issue proportionate fines directly, instead of relying on lengthy court cases, helping to stop harmful practices faster.
The Bill would also give the CCPC new powers to screen public procurement data to detect bid-rigging and anti-competitive behaviour. This is particularly important as the State increases capital spending on major infrastructure projects.
In addition, the legislation would update the Consumer Rights Act 2022 to give clearer rules on price reductions and contract cancellations, helping consumers better understand their rights.
Deputy Clendennen said consumers should be aware that the changes are still being developed and that public input is important.
“A public consultation is now open until 27 February. I would encourage consumer groups, businesses and members of the public to have their say. These changes will affect how consumer law is enforced, so it is important that people engage with the process.”
